These terms and conditions of use (“Terms of Use”) govern your use of our REACH Study Website (the “REACH Website”) owned and controlled by Seattle Children’s Hospital d.b.a. Seattle Children’s Research Institute (“Seattle Children’s”). The REACH Website is available to research participants for use in an IRB-approved study, STUDY00003420, “Randomized controlled trial of an internet-based prevention intervention for parents with irritable bowel syndrome (REACH)” (the “REACH Study”). The purpose of the REACH Study is to investigate how parents with IBS can help their young children develop healthy habits. The terms “you” and “your” as used in these Terms of Use mean you and any other person accessing your REACH Website Account.
You understand that this REACH Website does not contain or provide medical advice and is not a substitute for conferring with your healthcare provider. Rather, the REACH Website provides educational videos and other educational materials that may help with development of healthy habits. Your healthcare provider will not have access to the information you have entered in this REACH Website or communications we may have with you about your use of the REACH Website. You understand that no information in the REACH Website or communications about your use of the REACH Website will be included in or part of any medical record or clinical information system.
Your acceptance of, and compliance with, these Terms of Use is a condition to your use of the REACH Website. By clicking “accept” you acknowledge that you have read, understand, and accept all terms and conditions contained within these Terms of Use, the REACH Study Website Privacy Policy, and any other consents, authorizations, policies, terms and conditions presented to you or agreed to by you in connection with your use of the REACH Website, including Informed Consent Forms. If you do not agree to be bound by these terms, you are not authorized to access or use this REACH Website; promptly exit this REACH Website.
- No Medical Care or Advice Provided by Seattle Children’s
We offer the REACH Website for use by research participants. The REACH Website provides educational information about developing healthy habits for young children. Your use of our REACH Website and any communications we may have with you about the REACH Website is not intended to take the place of your relationship with your regular healthcare practitioners or primary care physician.
The content of our REACH Website and communications about the REACH Website, including, without limitation, text, copy, audio, video, photographs, illustrations, graphics, and other visuals, are for informational purposes only and do not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind by Seattle Children’s. You should always seek the advice of your qualified health care professional to address any questions or concerns you may have regarding your individual needs or any medical conditions. All information provided by Seattle Children’s, or in connection with any communications supported by Seattle Children’s, is intended to be for general information purposes only, and is in no way intended to create a provider-patient relationship with Seattle Children’s as defined by state or federal law.
- Not for Emergencies
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL “911” IMMEDIATELY.
The REACH Website is not for medical emergencies or urgent situations. You should not disregard or delay to seek medical advice based on anything that appears or does not appear on the REACH Website. If you believe you have an emergency, call 9-1-1 immediately.
You should seek emergency help or follow up care when recommended by a healthcare provider or when otherwise needed. You should continue to consult with your primary provider and other healthcare professionals as recommended. Always seek the advice of a physician or other qualified healthcare provider concerning questions you have regarding a medical condition and before stopping, starting, or modifying any treatment or medication.
- Availability of REACH Website
Seattle Children’s operates subject to Washington state and federal regulations, and the REACH Website may not be available in your state. Access to and use of the REACH Website is limited exclusively to users located in states within the United States.
- Eligibility; Website Access, Security, and Restrictions; Passwords
To participate in the REACH Study, you will be provided with a user name and password or other account credentials to access the REACH Website (“Account”). The user name and password are personal to you, and you are solely responsible for maintaining the confidentiality of your user name and password, and for all activities that occur under such user name and password. You agree to prohibit anyone else from using your user name and password and agree to immediately notify Seattle Children’s of any actual or suspected unauthorized use of your user name and password or other security concerns of which you become aware. Your access to the REACH Website may be revoked by Seattle Children’s at any time with or without cause.
You are prohibited from violating or attempting to violate the security of the REACH Website, including, without limitation: (a) accessing data not intended for you or logging onto a server or an account which you are not authorized to access; (b) attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; or (c) accessing or using the REACH Website or any portion thereof without authorization, in violation of these Terms of Use or in violation of applicable law.
You may not use the REACH Website for any purpose other than to participate in the REACH Study. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of this REACH Website or any activity being conducted on this REACH Website.
- Ownership Of The REACH Website And Related Materials; Additional Restrictions
All pages within this REACH Website and any material made available for download are the property of Seattle Children’s, or its licensors or suppliers, as applicable. The REACH Website is protected by United States and international copyright and trademark laws.
Subject to these Terms of Use, Seattle Children’s grants you a revocable, nontransferable (except as provided below), personal, nonexclusive license to use the REACH Website for purposes of participating in the REACH Study. All rights not expressly granted to you in these Terms of Use are reserved and retained by Seattle Children’s or its licensors, suppliers, publishers, rights holders, or other content providers. Neither the REACH Website, nor any part of the REACH Website, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Seattle Children’s. You may not frame or utilize framing techniques to enclose or deep link to any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Seattle Children’s without express written consent. You may not use any meta tags or any other “hidden text” utilizing Seattle Children’s name or trademarks without the express written consent of Seattle Children’s. You may not misuse the REACH Website. You may use the REACH Website only as permitted by law and as described in these Terms of Use, the Privacy Policy, and other documentation you have been provided by Seattle Children’s related to the REACH Study. The content of the REACH Website, including without limitation the files, documents, text, photographs, images, audio, and video, and any materials accessed through or made available for use or download through this REACH Website may not be copied, distributed, modified, reproduced, published, or used, in whole or in part, except for purposes authorized or approved in writing by Seattle Children’s.
- Users Under 18 Years Old
This REACH Website is not intended for use by anyone under the age of 18 years old. Parents must be over the age of 18 to participate in the REACH Study. The REACH Website will not collect information about your child and is not to be used by anyone under the age of 18. If you believe we may have collected information from a child without parental consent, please contact us at PPSI@seattlechildrens.org.
- Usage Data
Seattle Children’s may disclose usage data about your activity on the REACH Website to a third party service provider; however, the usage data is used by the service provider for purposes that support the REACH Study and will not contain your name.
- Intellectual Property
Seattle Children’s retains all right, title, and interest in and to the REACH Website, and any information, products, documentation, software, or other materials on the REACH Website, and any patent, copyright, trade secret, trademark, service mark, or other intellectual property, or proprietary right in any of the foregoing, except for information on the REACH Website licensed by Seattle Children’s. The information available through the REACH Website is the property of Seattle Children’s. You agree not to store, copy, modify, reproduce, retransmit, distribute, disseminate, rent, lease, loan, sell, publish, broadcast, display, or circulate such information to anyone. Use, reproduction, copying, or redistribution of Seattle Children’s trademarks, service marks, and logos are strictly prohibited without the prior written permission of Seattle Children’s. The immediately foregoing sentence also applies to any third party trademarks, service marks, and logos posted on the REACH Website. Nothing contained on the REACH Website should be construed as granting, by implication, estoppel, waiver, or otherwise, any license or right to use any trademarks, service marks, or logos displayed on the REACH Website without the written grant thereof by Seattle Children’s, or the third party owner of such trademarks, service marks, or logos. The REACH Website may contain other proprietary notices and copyright information, the terms of which you agree to follow.
Seattle Children’s may delete any information provided by you that it deems in its sole discretion fraudulent, abusive, defamatory, obscene, or in violation of copyright, trademark, or other intellectual property or ownership right of any other person or entity.
- Disclaimer of Warranties
THE REACH WEBSITE IS AN EXPERIMENTAL WEBSITE INTENDED FOR RESEARCH USE IN THE REACH STUDY AND NOT FOR ANY COMMERCIAL USE. AS SUCH, SEATTLE CHILDREN’S DOES NOT WARRANT THAT ACCESS TO OR USE OF THE REACH WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN THE REACH WEBSITE WILL BE CORRECTED. THIS REACH WEBSITE AND COMMUNICATIONS RELATED TO THE WEBSITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN THE WEBSITE OR ANY WEBSITE-RELATED SERVICE, ARE PROVIDED “AS IS,” WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY OF INFORMATION, QUIET ENJOYMENT, AND TITLE/NON-INFRINGEMENT. - Limitation of Contract Liability Regarding Use of REACH Website
EXCEPT AS PROVIDED BY LAW, AND WITHOUT LIMITATION:
SEATTLE CHILDREN’S AND ANY THIRD PARTIES MENTIONED ON THIS REACH WEBSITE ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST DATA ARISING OUT OF OR RELATING IN ANY WAY TO THE REACH WEBSITE), BASED ON ANY WARRANTY OR CONTRACT,THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- Dispute Resolution
We will try to work in good faith to resolve any issue you have with the REACH Website, if you bring that issue to the attention of our research team. However, we realize that there may be rare cases where we may not be able to resolve an issue to an individual’s satisfaction. You and Seattle Children’s agree that any dispute, claim, or controversy arising out of or relating in any way to these Terms of Use or your use of the REACH Website, shall be determined in accordance with the laws of the State of Washington with exclusive jurisdiction and venue for any claims will in state or federal courts located in and for King County, WA, unless prohibited by law.
- Misuse of REACH Website
You agree to be responsible for all demands, losses, liabilities, damages, claims, causes of action, actions, and lawsuits arising out of: (a) your breach of the Terms of Use or Privacy Policy; or (b) any negligent or wrongful act or omission by you in your use or misuse of the REACH Website, or any information on the REACH Website, including without limitation, infringement of third party intellectual property rights, privacy rights, or negligent or wrongful conduct.
- REACH Website Support; Functionality
All questions and requests relating to REACH Website support must be directed to Seattle Children’s. To submit a support request, please email us at PPSI@seattlechildrens.org. Please note that we may change or remove functionality and other features of the REACH Website at any time, without notice.
- Revisions; General
Seattle Children’s reserves the right, in its sole discretion, to terminate your access to all or part of this REACH Website, with or without cause, and with or without notice. In the event that any of the Terms of Use are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect. These Terms of Use constitute the entire agreement between Seattle Children’s and you pertaining to the subject matter hereof. For purposes of these Terms of Use, (a) the words “include,” “includes,” and “including” are deemed to be followed by the words “without limitation”; (b) the word “or” is not exclusive; and (c) the words “herein,” “hereof,” “hereby,” “hereto,” and “hereunder” refer to these Terms of Use as a whole.
